Principles for the provision of information

Provision of information under Act No. 106/1999 Coll., on free access to information

In accordance with the Government Resolution No. 875 of 6 September 2000 on the Methodological Instruction on the unification of the procedure of public administration bodies in ensuring the right of natural and legal persons to provide information under Act No. 106/1999 Coll., on free access to information, we present the requested information:

  • Establishment of the MÚA

Time limits that must be observed by law

  • the request is made on the date on which it is received by the obliged body
  • within 7 calendar days from the date of submission, communicate to the applicant the details of the publication of the information
  • within 7 calendar days of the date of submission, ask the applicant to specify the information requested
  • if the MCA (contact person) does not receive clarifying information from the applicant, reject the request within 30 calendar days of the request
  • the applicant shall be informed of the postponement of the application within 3 calendar days of the postponement, but at the latest within the time limit laid down by law for the processing of the application
  • the requested information is provided by the obliged entity within a basic time limit of 15 calendar days of the request
  • the period of 15 calendar days may be extended by a maximum of 10 calendar days, i.e. to 25 calendar days, only for serious reasons, which are:
    • searching for and collecting the requested information in other fields
    • a request for a voluminous amount of separate and distinct information in a single application
    • the need to consult another obliged entity (or two or more components of an obliged entity) which has a substantial interest in the subject matter of the request
    • the applicant is informed within 15 calendar days of any extension of the basic time limit and the reasons for it
    • the period for the applicant to appeal shall be 15 calendar days from receipt of the decision

Method of submitting a request for information

  • the request for information shall be made orally or in writing, including via an electronic communications network or service
  • if the applicant is not provided with information in response to an oral request or if the applicant does not consider the information provided to be sufficient, the request must be made in writing
  • it must be clear from the request to which obliged body it is addressed and that the applicant is seeking information within the meaning of this Act. In the request, the natural person shall state his or her name, surname, date of birth, address of permanent residence or, if he or she is not registered as a permanent resident, address of residence and address for service, if different from the address of permanent residence or domicile. A legal person shall indicate its name, identification number, registered office address and address for service, if different from the registered office address. The address for service shall also mean the electronic address.
  • if the application is made electronically, it must be submitted to the electronic address given above
